The Government of Denmark declares that it withdraws the declaration of non-application of Protocol No. 13 to the Faroe Islands.

    Georgia :

Georgia declares, that until the full jurisdiction of Georgia is restored on the territories of Abkhazia and Tskhinvali Region, it cannot be held liable for the violations on these territories of the provisions of Protocol No. 13.

    Moldova :

Moldova declares that, until the full re-establishment of the territorial integrity of the Republic of Moldova, the provisions of the Protocol shall be applied only on the territory controlled effectively by the authorities of the Republic of Moldova.

The Kingdom of the Netherlands accepts the Protocol for the Kingdom in Europe, the Netherlands Antilles and Aruba.

    Spain :


Declaration contained in the instrument of ratification deposited on 16 December 2009 - Or. Engl.

If this Protocol were to be extended by the United Kingdom to Gibraltar, Spain would like to make the following declaration:

1. Gibraltar is a non-autonomous territory whose international relations come under the responsibility of the United Kingdom and which is subject to a decolonisation process in accordance with the relevant decisions and resolutions of the General Assembly of the United Nations.

2. The authorities of Gibraltar have a local character and exercise exclusively internal competences which have their origin and their foundation in a distribution and attribution of competences performed by the United Kingdom in compliance with its internal legislation, in its capacity as sovereign State on which the mentioned non-autonomous territory depends.

3. As a result, the eventual participation of the Gibraltarian authorities in the application of this Protocol will be understood as carried out exclusively as part of the internal competences of Gibraltar and cannot be considered to modify in any way what was established in the two previous paragraphs.

    United Kingdom :

In accordance with Article 4 of the Protocol, the Government of the United Kingdom declares that the United Kingdom will initially apply the Protocol to the metropolitan area of Great Britain and Northern Ireland.

The Government of the United Kingdom declares that it extends the application of Protocol No. 13 to the Convention for the Protection of Human Rights and Fundamental Freedoms to Anguilla, Bermuda, the Falkland Islands, Gibraltar, Montserrat, St Helena, Ascension and Tristan da Cunha (*), South Georgia and the South Sandwich Islands, and the Turks and Caicos Islands, being territories for whose international relations the Government of the United Kingdom are responsible.

I have the honour to inform you that, pursuant to the St Helena, Ascension and Tristan da Cunha Constitution Order 2009 (United Kingdom Statutory Instrument 2009/1751), the name of the British overseas territory formerly called "St Helena and Dependencies" has been changed to "St Helena, Ascension and Tristan da Cunha". The status of the territory as a British overseas territory is unchanged, and accordingly the United Kingdom remains responsible for its external relations. To the extent that treaties extend to St Helena and Dependencies, they continue to extend to St Helena, Ascension and Tristan da Cunha.
