    Allemagne :

In the Federal Republic of Germany, the scope of the Charter is confined to Gemeinden, Verbandsgemeinden and Kreise in Land Rhineland-Palatinate and to Gemeinden and Kreise in the other Länder.

In accordance with Article 13 of the Charter, the Kingdom of Belgium considers that it intends to confine the scope of the Charter to the provinces and municipalities. In accordance with the same Article, the provisions of the Charter do not apply to the "Centres publics d'Aide sociale" (CPAS) on the territory of the Brussels-Capital Region.

    Bulgarie :

In accordance with Article 12, paragraph 3, of the European Charter of Local Self-Government, the Republic of Bulgaria withdraws its declaration with regards to Article 7, paragraph 2 of this treaty, following the adoption of a Law to this effect by the National Assembly of the Republic of Bulgaria on 11 July 2012, and will henceforth be bound also by the said provision.Note by the Secretariat:

The declaration made at the time of ratification of the Charter by Bulgaria reads henceforth as follows:

“The Republic of Bulgaria shall be considered bound by all the paragraphs of Part I of the European Charter.”

The Danish Government has decided with effect as from 1 January 2007 to withdraw the declaration made at the time of deposit of its instrument of acceptance of the Charter, and make the following new declaration on the scope of the Charter in Denmark:

In accordance with Articles 13 and 16 of the Charter, the Kingdom of Denmark considers that the provisions of the Charter shall apply to its municipalities ("kommuner").

    Espagne :

The Kingdom of Spain declares that the European Charter of Local Self-Government shall apply to the whole national territory as far as the authorities regulated by the Spanish law on local authorities and foreseen in Articles 140 and 141 of the Constitution are concerned.

The French Republic therefore considers that the public establishments of intercommunal cooperation, which are not territorial authorities, are excluded from the scope of application of the Charter.

In accordance with Article 12, paragraph 3, of the Charter, Malta declares that it has decided to accept Article 7, paragraph 2, and Article 9, paragraphs 4, 5 and 6, of the Charter.

Malta has been a signatory to the Charter since the introduction of local government in the country in 1993, having signed the Charter on 13 July 1993 and ratified it on 6 September 1993. Following the recent reform in the local councils legislation, and taking into account that Malta is already compliant with the above-mentioned four paragraphs, Malta would like to consider itself bound by them.

The Princely Government recalls that the territory of the Principality, with a surface area of approximately 2 km², constitutes only one municipality which is an autonomous institution established by the Constitution, endowed with legal personality and governed by public law.
Therefore, the concept of local self-government as stipulated in Article 3 of this Charter applies there, in Monaco, in light of the specific institutional and geographical characteristics of the country, within the framework defined by Title IX of the Constitution and by law No. 959 of 24 July 1974 on communal organisation, as amended.

"During the review of the ratification procedure, the competent authorities of Montenegro have noticed an important administrative mistake. The Instrument of Ratification of the European Charter of Local Self-Government does not contain the declaration regarding Montenegro's implementation of the Charter, despite the fact that it is required by Article 3 of the Law on Ratification of the European Charter of Self-Government, adopted by the Parliament of Montenegro on 29 July 2008.
Given the fact that the Montenegrin authorities have been implementing the Charter so far in accordance with the Law on Ratification of the European Charter of Self-Government and the said Declaration, the Permanent Representation of Montenegro has the honour to request that the mentioned Declaration is deemed to be included in the Instrument of Ratification of the European Charter of Self-Government.

With regard to Article 6, paragraph 2, of the Charter, the Government of the Kingdom of the Netherlands takes the view that, in the framework of the Charter, only Article 9 of the Charter has any bearing on the financial resources of local authorities. This means that local authorities may not take any financial claims on central government based on the provisions of Article 6, paragraph 2, of the Charter. In the opinion of the Government of the Kingdom of the Netherlands, Dutch legislation is in accord with both the wording and the purport of Article 6, paragraph 2, of the Charter.
